The Decorative Hardwoods Association reports that the parties in Sierra Club v. Pruitt have reached an agreement that sets the “manufactured by” dates for the Formaldehyde Act of Title VI of the Toxic Substances Control Act to June 1, 2018 for producers and fabricators of composite wood panels.
Products certified by a CARB TPC that is also recognized by EPA will be recognized as compliant until March 22, 2019.
After March 22, 2019, only TSCA Title VI compliant and labeled products will be allowed. The agreement preserves the sell-through provision and applies to panels and finished goods manufactured prior to June 1, 2018.
